
EU AI Act Risk Classification: Where Do Your AI Agents Sit?
The EU AI Act classifies AI systems into four risk tiers — unacceptable, high-risk, limited risk, and minimal risk — each carrying dramatically different compliance obligations. For organisations deploying AI agents across their enterprise, the classification tier your systems fall into determines everything: whether you need a full conformity assessment or simply a transparency notice, whether you face fines up to EUR 35 million or no regulatory burden at all.
Most enterprises assume their AI agents sit comfortably in the limited or minimal risk categories. Most of them are wrong.
The Four Risk Tiers Under the EU AI Act
The EU AI Act (Regulation (EU) 2024/1689) establishes a risk-based regulatory framework that became enforceable in phases starting August 2024, with high-risk AI system obligations taking full effect on 2 August 2026. The four tiers are structured as follows.

Tier 1: Unacceptable Risk — Banned Outright
Certain AI applications are prohibited entirely under Article 5 of the EU AI Act. These include AI systems that deploy subliminal manipulation techniques to distort behaviour, exploit vulnerabilities based on age, disability, or socio-economic status, enable social scoring by public authorities, or perform real-time remote biometric identification in public spaces (with narrow law enforcement exceptions).
Penalties for deploying prohibited AI systems reach up to EUR 35 million or 7% of global annual turnover — whichever is higher. There is no compliance pathway. These systems cannot be placed on the EU market under any circumstances.
Tier 2: High-Risk — Full Compliance Suite Required
High-risk AI systems face the most extensive regulatory obligations under the EU AI Act. A system is classified as high-risk if it falls into one of two categories: it is a safety component of a product already covered by EU harmonisation legislation (medical devices, machinery, vehicles), or its intended use falls under one of the eight Annex III categories.
Those eight Annex III categories cover biometrics, critical infrastructure, education and vocational training, employment and worker management, access to essential services (including credit scoring and insurance pricing), law enforcement, migration and border control, and administration of justice.
The compliance burden for high-risk AI systems is substantial. Article 9 requires a risk management system maintained across the entire AI system lifecycle — not a one-time assessment. Article 10 mandates data governance procedures with bias detection and mitigation. Article 11 requires technical documentation demonstrating compliance. Article 13 imposes transparency obligations ensuring deployers understand the system's capabilities and limitations. Article 14 requires human oversight mechanisms allowing operators to monitor, interpret, and override AI decisions. Article 15 demands accuracy, robustness, and cybersecurity testing. And Article 12 requires automatic logging with a minimum of six months of log retention.
In short: risk management, data governance, technical documentation, transparency, human oversight, accuracy testing, and automatic logging — all mandatory, all auditable.
High-Risk AI Systems — Mandatory Compliance Requirements
Tier 3: Limited Risk — Transparency Obligations
Limited risk applies to AI systems that interact directly with individuals — chatbots, deepfakes, emotion recognition systems used outside high-risk contexts — where the primary obligation is transparency. Users must be informed they are interacting with an AI system, and AI-generated content must be labelled as such.
No conformity assessment. No EU database registration. No mandatory risk management system. The compliance burden is comparatively light.
Tier 4: Minimal Risk — Self-Regulation
The majority of AI systems in the EU market today fall into this category: spam filters, AI-enabled video games, basic recommendation engines. No mandatory obligations apply. Providers may voluntarily adopt codes of conduct, but the EU AI Act imposes no regulatory requirements.
Why Most Enterprise AI Agents Trigger High-Risk Classification
Here is where the gap between assumption and reality becomes dangerous.
Most enterprise AI agents are not spam filters or video games. They are systems that make or influence decisions affecting individuals — and that is precisely the threshold that triggers high-risk classification under the EU AI Act.
Consider the AI agents commonly deployed across enterprise environments:
An AI agent that screens CVs, ranks candidates, or evaluates employee performance falls under Annex III Category 4: employment, worker management, and access to self-employment. High-risk.
An AI agent that assesses creditworthiness, calculates insurance premiums, or determines loan eligibility falls under Annex III Category 5: access to essential private services. High-risk.
An AI agent that triages customer support tickets, prioritises service requests, or determines access to public benefits — again, Annex III Category 5. High-risk.
An AI agent managing network infrastructure, energy distribution, or water supply systems falls under Annex III Category 2: critical infrastructure. High-risk.
Enterprise AI Agents — Common Use Cases and Risk Classification
And there is a critical catch-all provision that many organisations miss entirely: under Article 6(2), any AI system listed in Annex III that performs profiling of natural persons — automated processing of personal data to evaluate aspects of someone's work performance, economic situation, health, preferences, behaviour, or location — is always classified as high-risk, regardless of whether it meets any other exemption criteria.
That profiling provision alone captures a significant portion of enterprise AI agents. Customer segmentation engines, workforce analytics tools, personalisation algorithms, predictive churn models — if they process personal data to evaluate aspects of an individual's life, they are high-risk by default.
The Grey Area Between Limited and High Risk
The EU AI Act does provide a narrow set of exemptions under Article 6(3). An AI system listed in Annex III may not be considered high-risk if it meets one of four conditions: it performs a narrow procedural task, it improves the result of a previously completed human activity, it detects decision-making patterns without replacing or influencing human assessment, or it performs a preparatory task for an assessment relevant to Annex III use cases.
These exemptions are narrower than they appear. The key qualifier is that the system must not "materially influence the outcome of decision-making." An AI agent that pre-screens applications before a human reviews them might qualify — but only if the human genuinely has the authority and information to override the AI's recommendation. If the human rubber-stamps the AI output in practice, the exemption does not apply.
Providers who believe their system qualifies for an exemption must document that assessment before placing the system on the market, under Article 6(4). Regulators can challenge that assessment at any time under Article 80. The burden of proof sits with the provider, not the regulator.
Article 6(3) Exemptions — When an Annex III System May Not Be High-Risk
The European Commission was required to publish practical guidelines with examples of high-risk and non-high-risk AI systems by February 2026 under Article 6(5). These guidelines are intended to reduce ambiguity — but until classification disputes are tested through enforcement, the grey area remains a risk in itself.
For organisations navigating this uncertainty, the prudent approach is clear: if there is any doubt about whether your AI agent is high-risk, classify it as high-risk. The cost of over-compliance is operational overhead. The cost of under-compliance is up to EUR 15 million or 3% of global turnover for misclassification — and up to EUR 35 million or 7% for deploying a non-compliant high-risk system.
What This Means for Your Organisation Before August 2026
The high-risk obligations for Annex III AI systems — the standalone enterprise use cases like hiring, credit scoring, and customer service — apply from 2 August 2026. That deadline is now less than four months away.
Three steps matter now.
First, inventory every AI system in your organisation. You cannot classify what you have not catalogued. Shadow AI — models deployed by individual teams without central oversight — is the single largest classification risk most enterprises face.
Second, classify each system against the four risk tiers, with particular attention to the Annex III categories and the profiling provision under Article 6(2). Document your classification rationale for every system, including those you determine are not high-risk.
Third, for every system classified as high-risk, assess your readiness against the seven mandatory requirements: risk management (Article 9), data governance (Article 10), technical documentation (Article 11), record-keeping (Article 12), transparency (Article 13), human oversight (Article 14), and accuracy, robustness, and cybersecurity (Article 15).
